The New Civil Code and its Impact on Conceptual Changes in Civil Procedure

Abstract: The new Civil Code must accompany changes in rules of procedure, which allow judicial implementation of a number of new institutes of substantive law, which are established by the code. Approval of these procedural norms (in particular the Act on specific types of management and the harmonization amendment CPC) is expected in mid-2013. The legislature used these legislative proposals to assert some new ideas, which to some extent may change the nature of Czech civil process. The author attempts to evaluate these changes.
