The legal Effects for the Presumption of Death

Abstract: Proceedings in case of presumption of death has significantly changed with the effect of the new Civil Code. The article deals with these changes and evaluates them. The author of the Article draws attention to the problematic parts of the new legislation and attempts at its interpretation. The article mainly deals with the effects of a judgment of presumption of a person dead. The effects of this judgment were by earlier legislation somewhat controversial. Author believes that even the new legislation is not clear.
