Abstract: The article deals with the use of the criteria of the local jurisdiction for determination of competence in proceedings with a foreign element. It concludes that it is necessary to apply the principle perpetuatio iurisdictionis and the principle perpetuatio fori for the international jurisdiction of the state, i. e. national jurisdiction of the court.
