Selection of European Courts: What Is Decisive, Expertise or Politics?
Jurisprudence 6/2018 Section: Articles Page: 22–36
Keywords: Court of Justice of the European Union, European Court of Human Rights, judicial selection, politics, expertise
Abstract: The article introduces judicial selection procedures for two European apex courts: the Court of Justice of the European Union and the European Court of Human Rights. In both cases, the structure of the article reflects three relatively independent stages of these procedures: national selections, expert assessment at the supranational level and the final (s)election at the supranational level. While analysing the individual stages, the respective roles of politics and expertise in the selection procedures are emphasised.
