Abstract: On 28 September 2022, long years of preparation in the European Commission have finally materialized in the publication of a proposal for a Directive of the European Parliament and of the Council on liability for defective products, which should replace the currently effective Directive 85/374/EEC. The revised rules are intended to provide victims with a high level of protection in today’s world, not only by adapting the instrument to new technologies and new business models, but also by strengthening their position in court proceedings. All this without disrupting the balance with the legitimate interests of producers. This paper introduces the reader to the main changes brought about by the proposal and highlights some of the provisions whose development in the European legislative process might be worth following.
