Abstract: The presented article deals with the procedural aspects to determination of paternity after the recodification of private law, during which the legal regulation was moved from the Code of Civil Procedure to the Act on Special Court Proceedings and which, at the same time, also changed the overall concept of the understanding of these proceedings. The article aims to describe selected procedural aspects to determination of paternity, to draw attention to the pros and cons of the current legislation and to try to propose a solution de lege ferenda. The goal of the article is also to analyse the current decision-making practice of selected Czech courts of first instance and to evaluate how the described legislation is applied.
