Abstract: The article draws attention to the fact that the Guardian Council is institute which is essentially new in the Czech Law an,. The new Civil Code presupposes that its establishment will take place informally, usually without the assistance of the Court. At the time of its election, nobody is entitled to verify whether the electors of the Guardian Council and its members have a real relationship towards the ward. The correctness of the election of members of the Council and its decision will be a subject of review only after the evaluations and proposal (not ex officio).
