Abstract: According to the stated obligation, the administrative body may not prevent the persons concerned from exercising their rights and legitimate interests. In accordance with the jurisprudence of administrative courts, these persons can also include associations whose main mission is environmental protection. The contribution aims to define in detail the conditions for the participation of these associations in administrative proceedings, to map the decisions of administrative courts, by which the participation of said associations in administrative proceedings was approved, and also to deal with the issue of their active procedural legitimacy in the proceedings of lawsuits against the decision of the administrative body.
