On the pitfalls of regarding EU Charter of Fundamental Rights as further yardstick for constitutional review in Czechia
Jurisprudence 5/2024 Section: Articles Page: 1-6
Keywords: Czech Constitutional Court; EU Charter of Fundamental Rights; constitutional review
Abstract: The article reacts on those judgements of the Czech Constitutional Court where the Court regarded the EU Charter of Fundamental Rights as a further yardstick for constitutional review in Czechia. It is argued in the article against such approach of the Court towards the Charter. The article leads into proposing that the approach of the Court towards the Charter should be in line with its well-settled approach towards Article 267 of the Treaty on the Functioning of the EU.
