Functioning of the EU sanction regimes in the light of the final judgment

Abstract: The final judgment of the Court of Justice concerning legality of acts by which Mr. Kadi, because of his alleged link to the al-Qaeda net, was listed on the Union sanction list, confirmed that „in principle full review“ of legality of Union acts has to be done also in case of acts implementing resolutions of UN Security Council and pointed to the discrepancies in the treatment of information of confidential nature during the court proceedings. The judgement is crucial from the point of view of functioning of all EU sanction regimes which use the so called smart sanctions.
